Türkiye Abolishes 46-Year-Old Police Regulation

3 min read

A rule issued in the Official Gazette revoked Türkiye’s 46-year-old legislation guiding the functioning methods and principles of the Police Disciplinary Boards.

While headlines like “Which regulation was abolished in the police organisation?”, “Latest news on the Police Organization regulation,” and “Official Gazette decision on the police force” dominated public discourse, the Ministry of Interior published a new regulation in the Official Gazette, and it went into effect. This judgement overturned the long-standing regulation guiding the functioning methods and principles of the police organisation’s disciplinary bodies. This regulation governing the security bureaucracy was one of the changes keenly monitored by police officers and public administration officials.

With an increase in searches for “police regulations change”, “latest news from the police force,” and “police disciplinary boards”, the new regulation is viewed as a significant step forward in terms of administrative procedures inside the police department. Following the revocation of a regulation that had been in existence since around 1980, emphasis has shifted to the legislation and regulations that will be introduced in the next future.

While the public is curious about how the disciplinary processes within the police force will be altered following the judgement published in the Official Gazette, developments in the case are constantly monitored.

WHAT REGULATION WAS ABOLISHED BY THE TURKISH POLICE FORCE?

The regulation that was repealed was the Regulation on the Working Principles and Procedures of the Disciplinary Boards of the Police Organisation.

While headlines such as “Which regulation was abolished in the Police Department?”, “Latest Police Regulations”, and “Official Gazette Police Decision” remain on the agenda, the new regulation prepared by the Ministry of Interior has been published in the Official Gazette and has entered into force.

As part of the decision, the Regulation on the Working Principles and Procedures of the Disciplinary Boards of the Police Organisation, which had been in effect since April 5, 1980, was repealed. Thus, the regulation that had defined the framework for the working procedures of the disciplinary boards in the police organization for many years officially came to an end.

According to the document published in the Official Gazette, the decision to repeal the rule took effect on the date of publication, and the Minister of Interior will have the ability to execute it.

The repeal of the rule, which had been in place for roughly 46 years, resulted in the regulation losing its legal validity, and the public has began to closely monitor the specifics of the new period regarding the legislative framework of the police force.

What topics were covered by the repealed regulation?

The repealed legislation set the fundamental structure and legal constraints for the disciplinary system within the police organisation. The regulation addressed the following key issues:

The establishment of disciplinary boards, the majority necessary for their meetings, and the decision-making processes.

Rules governing the situations under which members may not attend meetings.

The reporting system and processes for carrying out disciplinary investigations.

The need to seek defences in investigations, as well as to notify and implement decisions.

Disciplinary actions should be conducted separate from criminal justice proceedings.

The functions and powers of the Ministry of Interior’s High Disciplinary Board.
